You can enter into or establish an agreement with a resident depending on their disability.
You must enter into or establish the agreement before the resident moves in. For what to do in exceptional circumstances where an SDA resident is already occupying an SDA dwelling before an SDA residency agreement is signed, read Exceptional agreement orders.
Entering into an SDA residency agreement
You enter into an SDA residency agreement if the resident can understand the information statement and can sign the agreement.
To enter into an agreement, follow these steps:
1. Give a copy of the SDA residency agreement and information statement to the resident (and if applicable, to their support person)
2. Explain the information statement and agreement to the resident and their support person in a manner they can understand.
3. Sign the agreement with the resident. You must give the resident the information statement at least 7 days before you both sign the agreement.
4. Notify us of the agreement within 14 days.
Establishing an SDA residency agreement
An SDA residency agreement can be established if the resident does not have the physical or cognitive ability to sign the agreement.
To establish an agreement, follow these steps:
- First, explain the agreement in the language, mode of communication and terms the SDA resident is most likely to understand. If reasonable, this must be both orally and in writing.
- If the SDA resident would benefit from or needs support to read and understand the agreement, you must also give a copy of the SDA residency agreement and information statement to:
- the resident’s guardian or administrator (if any), and
- to a family member, carer, advocate or other support person chosen by the resident, or if they don’t have any of those specific support people, a person you consider can help the resident – but this person must not work for you or be connected to your organisation.
- Sign the SDA residency agreement. The resident does not need to sign it. Note: You must give the information statement to the resident and the resident's support person at least 7 days before you sign the agreement.
- Notify us of the agreement within 14 days.
Entering into a residential rental agreement (short-term or long-term)
This is the same process as a standard rental agreement.
The resident must be able to understand the agreement and sign it. It must be the resident’s choice whether they prefer to sign a residential rental agreement or an SDA residency agreement.

Follow these steps:
- Give the resident and their support person a copy of the residential rental agreement and its information statement.
- Explain the information statement in a way the resident can understand.
- Sign the agreement with the resident. There must be at least 7 days between when you gave the resident the information statement and when you both sign the agreement.
- Give the resident and their support person a copy of the signed agreement within 14 days of signing.
- Give the resident a copy of our Renters guide on or before the day they move into the home. This guide has detailed information on renting rights and 桃色视频 at the beginning, middle and end of a rental agreement.
Additional terms
You must use the ‘prescribed form’ when entering into a residential rental agreement. You cannot create your own residential rental agreement. To download the prescribed agreements, go to Resources for providers.
You can include extra terms and conditions, as long as they are not prohibited by the law. You must not include terms which take away any of the rights and 桃色视频 provided for by the law. Penalties apply for including a prohibited term in a rental agreement.
If you do not give a resident who has signed an agreement the required information statement, they can end the agreement.
